Terms of Use

1. Nature of Service and Acceptance

ForgeBio.io is the digital identity management platform developed and provided by Web Forge Pro (Joaquim Llort Grau) (hereinafter, “the Platform”).

Free access to the Platform is offered as a courtesy service, with no mandatory financial consideration. The User acknowledges that the use of the free version does not generate a guaranteed service provider contractual relationship.

By registering, the User accepts that the Platform may evolve, be modified, suspended, or discontinued, in whole or in part, without this generating any right to financial compensation.

2. “AS IS” Service and Development Status

The Platform is provided “AS IS” and “AS AVAILABLE”. The User acknowledges that the service is under continuous development and may present errors, interruptions, or functional changes.

There is no guarantee that the service will be uninterrupted, error-free, or that it will meet the User's specific needs. Use of the Platform is at the User's sole risk.

3. Content and User Responsibility

Through ForgeBio.io, Web Forge Pro acts exclusively as a technical hosting and tool provider, without prior supervision of published content. The User declares to be the legitimate owner of the content they publish and assumes full responsibility for it.

It is prohibited to use the Platform for:

• Illicit, fraudulent, deceptive, or spam activities.
• Violent, hateful, discriminatory, or sexually explicit content.
• Infringement of third-party intellectual or industrial property rights.

3.1. Analytics Tools and Tracking Pixels (PRO Accounts)

Users with advanced plans (PRO) have access to tools that allow the integration of third-party tracking pixels and analytics (such as Meta, Google, TikTok, LinkedIn, among others) into their public profiles.

By using these features, the User assumes the position of Data Controller vis-à-vis the visitors to their profile. It is the sole responsibility of the User to ensure that the use of such pixels and the processing of their visitors' data strictly comply with the General Data Protection Regulation (GDPR), the Spanish LOPDGDD and any other applicable legislation.

As a compliance aid, ForgeBio.io automatically displays a technical consent banner on public profiles when configured pixels are detected. This banner blocks pixel loading until the visitor grants explicit consent, and applies invalidation rules (12-month TTL + invalidation when active pixels change). Ultimate responsibility for compliance remains with the User profile owner, including any need for additional or customized mechanisms.

Web Forge Pro acts solely as a mere technological intermediary (infrastructure provider — LSSI-CE Art. 16) and expressly disclaims any liability, sanction, fine, or third-party claim arising from the tracking, data collection, or use of analytical tools that the User configures on their profile. The User agrees to hold Web Forge Pro harmless against any litigation arising from these practices.

3.2. Uploaded Visual Content (Avatars, Backgrounds, Brand Images)

The Platform allows the User to upload images that will be displayed on their public profile (avatar, bio background, Marketing Kit logo, etc.). These features may be available, in whole or in part, in the free plan as a courtesy of the Service.

By uploading any image, the User declares and warrants:

• To be the legitimate owner of the exploitation rights over the image, or to have sufficient license/authorization for its publication on a publicly accessible web platform.
• That the image does not infringe copyright, trademark, image, privacy or honor rights of third parties.
• That the image does not contain unlawful, offensive, sexually explicit, violent, hateful or discriminatory content, nor any content liable to cause moral or reputational damage to third parties.

Web Forge Pro does not perform prior filtering, automated moderation or human review of the visual content uploaded by the User. It acts as a mere technical host (LSSI-CE Art. 16). Notwithstanding this, Web Forge Pro reserves the right to remove, hide or require the deletion of any image upon a substantiated third-party complaint, legal requirement, or effective knowledge of its unlawful nature.

The User assumes full and entire responsibility for any claim arising from the visual content they host on the Platform, and undertakes to hold Web Forge Pro harmless against any sanction, lawsuit or judicial cost. The maximum financial liability of Web Forge Pro is limited as per §5.

Sustainability of free storage: the storage space offered for images on the free plan is a courtesy service whose real cost (servers, bandwidth, backups) is borne by Web Forge Pro. Should the aggregate volume of use compromise the economic viability of the service, Web Forge Pro reserves the right to introduce quotas, move this functionality to paid plans, or discontinue it, with reasonable advance notice (minimum 30 days) and guaranteeing the User the right to download their images during such period.

4. Suspension and Termination of Service

Web Forge Pro reserves the right to suspend or cancel access to the Platform when there is:

• Abusive or disproportionate use of resources.
• Technical, legal, or reputational risk.
• Reasonable indications of illicit activity.

Whenever possible, we will attempt to notify the User. Termination of the service implies deactivation of access, without obligation to keep the service active indefinitely.

👉 User rights regarding data protection shall be governed in accordance with the GDPR.

5. Limitation of Liability

To the maximum extent permitted by applicable law:

• Web Forge Pro shall not be liable for indirect damages, loss of data, revenue, profits, or business interruptions.
• Maximum financial liability shall be limited to the amount effectively paid by the User in the last 3 months.
• In the case of free services, maximum financial liability shall be €0.

Nothing in these terms limits the inalienable rights recognized by current regulations.

6. Modifications to Service and Terms

The Platform may evolve, change, or cease based on technical or strategic criteria. Web Forge Pro reserves the right to modify these terms, notifying via the Platform itself. Continued use of the service implies acceptance of the updated conditions.

7. Applicable Law and Jurisdiction

These terms are governed by Spanish legislation.

Any controversy shall be submitted to the courts and tribunals of Barcelona, unless otherwise provided by mandatory law.
